رعاية الأيتام شرعًا وقانونًا: أيتام داعش نموذجًا

إعتمد البحث المعنون (رعاية الأيتام شرعا وقانونا، أيتام داعش نموذجا) المنهج العلمي النظري الحديث الذي يجمع بين الشريعة والقانون، وقد تناولنا فيه التعريف بالأيتام شرعا وقانونا وأهمية الاهتمام بهم وبأحوالهم فهم محتاجون للرعاية لأنهم حرموا من عطف الأبوين وحنانهما الشيء الذي لا تعوضه الدنيا وما فيها وعززنا ذلک بالأدلة المعتبرة من الکتاب والسنة النبوية، وبيننا أن الله تبارک وتعالى دافع عن اليتامى وأموالهم وممتلکا تهم في القرآن الکريم بنصوص وردت فيه تدافع عنهم وعن أموالهم وتدعو إلى عدم هدرها والتصرف فيها إلا بالتي هي أحسن. کما ويتضمن البحث الجانب القانوني الوضعي الذي يتحدث عن الأطفال وحقوقهم في اللوائح القانونية العراقية والدساتير المعتمدة لدى المنظمة العالمية لحقوق الإنسان وبالأخص اليتامى منهم والتي يتبين فيها أنها لم تغفل عن حقوق الأطفال في العراق وفي العالم لأنهم أولى بالرعاية والحنان وهذا موثق بالقرارات والمواد القانونية المعتبرة والمعتمدة ونخص بالذکر في هذا المجال اليتامى من أولاد داعش المنظمة الإرهابية التي قاتلت في العراق وفي سوريا وأماکن أخرى وخلفت ورائها آلاف الضحايا فأيتامهم المنتمين إليهم کغيرهم لا حول لهم ولا قوة إذ باتوا ضحية أخطاء آبائهم وأمهاتهم وقد عرض البحث المقاربة الحمائية القانونية للطفل اليتيم الضحية الذي بات يعذب في السجون والمعتقلات فمتى تتحرک الضمائر والقلوب الحية لرفع الظلم عن هؤلاء الأطفال وإعادتهم إلى أوطانهم وأوطان آبائهم وأمهاتهم؟ وفي هذا الشأن يقترح البحث إعادة تأهيلهم عن طريق المراکز المتخصصة في رعاية الطفولة وتمتيعهم بحقهم في التمدرس والتداوي والمأکل والمسکن الملائمين وأن الضمير الإنساني مطالب بإيجاد حل جذري لإغاثة الأطفال والعوائل والأيتام فالشريعة والقانون صنوان لا ينفصلان يخدمان معا الإنسان وحقوقه في الدنيا.

The research also includes the statutory legal aspect that talks about children and their rights in the Iraqi legal regulations and the constitutions adopted by the International Organization for Human Rights, especially orphans, in which it is evident that they have not neglected the rights of children in Iraq and in the world because they are the first of care and affection, and this is documented by the decisions and legal materials considered and approved We particularly mention in this regard the orphans of the children of ISIS, the terrorist organization that fought in Iraq, in Syria and elsewhere and left thousands of victims behind. Their orphans belonging to them, like others, have no strength as they became a victim of the mistakes of their fathers and mothers. The research presented the legal protectionist approach to the orphan victim who has been tortured in prisons and detention centers. When do consciences and live hearts move to remove injustice from these children and return them to their homelands and the homelands of their fathers and mothers? In this regard, the research proposes to rehabilitate them through centers specializing in childhood care and enjoying their right to education, medical treatment, adequate food and housing, and that the human conscience is required to find a fundamental solution for the relief of children, families and orphans, as the legitimate (sharia) and law are an inseparable title that serves both man and his rights in the world.
