اتفاق التحکيم التجاري في القانون العراقي والقانون المصري والقانون القطري والقانون الفرنسي (دراسة مقارنة)

يشکل التحکيم عدالة خاصة موضوعة من قبل أطراف النزاع خارج الإطار الالزامي لقضاء الدولة؛ وهو حل للنزاع من طرف شخص أو عدة أشخاص اختارهم الأطراف بمحض إرادتهم للرجوع إليهم، لحل النزاع الذي يقوم من جراء إبرام عقود التجارة الدولية، والقوانين الداخلية لأغلب الدول تنظم التحکيم التجاري؛ لأنه يعتبر إجراء خاص لحل النزاعات، وهو نظام لعدالة خاصة يسمح بسحب الاختصاص لمحل نزاع معين من محاکم الدولة لإعطائه لأشخاص خواص يختارهم من حيث المبدأ الأطراف أنفسهم أو يتم اختيارهم بمساعدتهم، ويعتبر التحکيم نظام قانوني يتم بواسطته الفصل بحکم ملزم في نزاع قانوني بين طرفين أو أکثـر بواسـطة شـخص أو أشخاص من الغير يستمدون سلطتهم من اتفاق أطراف النزاع، وأصبح التحکيم حاليا من أهم الوسائل القانونية التي أتسع نطاقها، حتى أعترف بها وتم تنظيمها قانونيا في معظـم دول العالم، على الرغم من اختلاف أنظمتها القانونية وظروفها الاقتصادية، وذلک بغية تحقيق العدالة بين أطراف النزاع.

Arbitration constitutes private justice established by the parties to the dispute outside the mandatory framework of the jurisdiction of the state; it is a solution to the dispute by one or several persons whom the parties chose of their own volition to refer to, to resolve the dispute that arises as a result of the conclusion of international trade contracts, and the internal laws of most countries regulate arbitration Commercial because it is considered a special dispute resolution procedure, It is a system of special justice that allows the withdrawal of the jurisdiction of a specific dispute subject from the state’s courts to give it to private persons chosen in principle by the parties themselves or who are chosen with their assistance. From the agreement of the parties to the conflict, and arbitration has now become one of the most important legal means that have expanded in scope, to recognize and then regulate it legally in most countries of the world, despite the different legal systems and economic conditions, in order to achieve justice between the parties to the conflict.
