تحتل جهة الإدارة فى زمننا المعاصر مکانة لا تدانيها مکانة بين الافراد والشرکات, فقد بلغت أنشطتها درجة کبيرة من التزايد والتعدد والإتساع والتشعب, إذ إمتدت إلى مجالات کثيرة لم تکن تمتد إليها من قبل وذلک على أثر إندثار مفهوم "الدولة الحارسة" بوظائفها التقليدية واختصاصاتها المحدودة وظهور "الدولة التدخلية" بإختصاصاتها الواسعة, ووظائفها المتعددة وتدخلاتها المتشعبة فى العديد من المجالات والميادين التى کانت وقفا على النشاط الفردى الخاص بقصد إحداث تطوير کلى وشامل وقادر على إشباع الحاجات الجماعية المتزايدة للمجتمع, وذلک من خلال إبرامها العقود الإدارية التى سنتعرض خلال بحثنا الماثل إالى مفهوم العقود الإدارية وسماتها وذلک على النحو التالى.
