الضمانات القضائية لحرية الانتقال والسفر

تعتبر حرية الانتقال والسفر في مصاف الحريات العامة المصونة بالدستور، وتتصل بمفهوم الحرية الشخصية التي لا يجوز تقييدها دون سند من الدستور أو القانون- الأصل هو حرية التنقل والاستثناء هو المنع منه أو تقييده، وهذا المنع لا يملکه بحسب الأصل إلا قاضٍ بموجب حکم، أو عضو بالنيابة العامة يعهد إليه القانون بذلک، شريطة توافر حالة من الحالات التي تقضيها صيانة أمن المجتمع وحماية أفراده- مرور مواد الإغاثة والمساعدات من دولة إلى أخري سواء من خلال أراضيها أو عبر حدودها، يتعين ألا يکون مخالفًا لأحکام القانون الدولي بهتک سيادة الدولة على إقليمها وحدودها، أو خرقًا للإجراءات والنظم التي استنتها لذلک- لا يسوغ للمواطنين المصريين المطالبة بإيصال قوافل إغاثة إلى شعب آخر بأنفسهم مباشرة دون إتباع الإجراءات المرسومة والقواعد الموضوعة لعبور الأفراد والمساعدات والمعونات.
