إن البذرة الإنسانية ليست ککل أعضاء الجسم أو الخلايا الأخري فهي تحمل الشخص المحتمل وهي تحمل الميراث الانساني وتنقل الحياة.ولکن التطور البيولوجى الحديث جعل لتدخل الهندسة الوراثية والتلقيح الصناعى دورا کبيرا فى عمليات الأستنساخ البشرى الذى لم تنظمة معظم التشريعات واکتفت فقط بالقول بمنعه او اباحته دون تتشريع اوعقوبة اوضابط محد لما هو مباح أو ممنوع.کما ان الحاجة البشرية والضرورة الملحة لوجود إستنساخ الأعضاء او الخلايا أصبحت فى حاجة ماسة الى تدخل المشرع حتى لا يؤدى ذلک الى اختلاط فى الأنساب او الى العديد من الإنتهاکات الأخرى.
