مدى توافق قانون المعلومات الکويتي مع المعايير الدولية للحصول على المعلومات

بدأت السلطة التنفيذية عملها فى البداية بأسلوب السرية المطلقة، ثم ما لبثت تحت تأثير أفکار حقوق الإنسان أن أنتقلت إلى العلانية، وکان نتيجة ذلک ظهور جيل جديد من الحقوق يرمى إلى حق الإنسان فى الوصول إلى المعلومات ومراقبة شفافية الجهاز الإداري، وکانت الکويت من الدول العربية التى تقر قانونًا بهذا الشأن عام 2020 والذي يهدف إلى ضمان حق الحصول على المعلومات.
وتبين الدراسة أن قانون المعلومات الکويتي قد جاء متوافقًا مع المعايير الدولة للحصول على المعلومات، فقد راعى المشرع الکويتى حق الإنسان في الوصول والإطلاع على کل ما تقوم به السلطة التنفيذية، وذلک من أجل ضمان الشفافية الإدارية.
وإن کان موقف المشرع الکويتي يحتاج إلى مزيد من الترقية من أجل ضمان وجود مؤسسة إدارية مستقلة ومرکزية تعمل على ضمان جودة تطبيق القانون.
The executive authority began its work in the beginning in the manner of absolute secrecy, then it remained under the influence of the ideas of human rights. Kuwait was one of the Arab countries to pass a law in this regard in 2020, which aim to guarantee the right to obtain information.
The study show that the Kuwaiti information low was in line with the state’s standards for obtaining information the Kuwaiti legislator took into account the human rights access and be informed of every thing that the executive authority does, in order to ensure administrative transparency.
Although the position of the Kuwaiti legislator needs further promotion in order to ensure the existence of an independent and central administrative institution that works to ensure the quality of law enforcement.
