تأثير جائحة کورونا على تنفيذ عقود التجارة الدولية.

نتعرض في هذا البحث للإجابة على تساؤل هام يدور عن مدى إمکانية تصدي التشريعات والقوانين الحالية سواء کانت محلية أو دولية لخطر کورونا، وهل لهذا الفيروس بما يؤديه من تغير في الظروف تأثير على تنفيذ العقود الدولية، وخلصنا من بحثنا هذا الى أن جائحة کوفيد 19 قد يتم تکييفها على أنها قوة قاهرة إذا إستحال تنفيذ التزام المدين، أو على أنها ظرف طارئ إذا أمکن هذا التنفيذ ولکن بإرهاق للمدين کتقليص ساعات العمل، أو الغلق الجزئي للمحال والمصانع بعض الأيام، وقد يتم تکييف هذه الجائحة على أنها ظرف عادي ذلک إذا أمکن تنفيذ بنود العقد طبيعياً کأن يتم تنفيذ الإلتزام إلکترونياً مثلاً.
In this research, we are exposed to answering an important question about the extent to which current legislation and laws, whether local or international, can address the threat of Corona, and does this virus, with its change in circumstances, have an impact on the implementation of international contracts, and we concluded from this research that the Covid 19 pandemic may take place. Adapting it as a force majeure if it is impossible to implement the debtor’s obligation, or as an emergency circumstance if this implementation is possible, but with fatigue for the debtor, such as reducing working hours, or partial closure of shops and factories some days, and this pandemic may be adapted as a normal circumstance that if the terms of the contract can be implemented Naturally, for example, the commitment is executed electronically.
