حازت العملات المشفرة، لا سيما عملة البيتكوين باعتبارها نموذجًا رائدًا في هذا المجال، على اهتمام كثير من الهيئات الدولية والنظم التشريعية والفقه المقارن، لما ثبت عن تعبيرها عن ثورة تقنية تهدم الكثير من الثوابت الراسخة، لا سيما في مجال سيطرة الدولة على النظام المالي، ولما ثبت عن امتلاكها لعدد من الميزات التي تجعلها جذابة للمجرمين. على وجه التحديد، لُوحظ أن غاسلي الأموال ينجذبون إلى إخفاء الهوية، وسهولة التحويل عبر الحدود، والافتقار إلى لوائح واضحة، ونهائية التسوية التي تصاحب معاملات العملة المشفرة.
وقد سعينا إلى تسليط الضوء على مخاطر العملات المشفرة باستخدامها في جرائم غسل الأموال، من خلال الاعتماد على المنهج التأصيلي التحليلي. كما اعتمدنا على المنهج المقارن بدراسة النهج الدولي ممثلاً في موقف منظمة الأمم المتحدة ومجموعة العمل المالي، والنهج التشريعي ممثلًا في التشريع الفيدرالي الأمريكي والتشريع المصري للوقوف على كافة المخاطر المحتملة للعملات المشفرة وإدراك أفضل الممارسات التشريعية المتبعة في المكافحة وتحديد نقاط القوة والضعف والفاعلية وفرص التحسين، بما نصل معه إلى تقييم ناجح للمعالجة المصرية لمخاطر العملات المشفرة وتقدير أوجه استجاباتها للخطر المُستحدث.
وقد حاولنا الوصول إلي هذا الهدف من خلال تقسيم البحث ذاته إلى ثلاثة فصول. تعرضنا في الفصل الأول إلى مفهوم العملات المشفرة وطبيعتها القانونية. وخصصنا الفصل الثاني لتقييم مخاطر العملات المشفرة في جرائم غسل الأموال. وتناولنا في الفصل الثالث والأخير للنهج الدولي والتشريعي المقارن في التصدي لمخاطر العملات المشفرة في غسل الأموال. ثم ختمنا هذا البحث ببيان أهم النتائج والتوصيات التي أسفرت عنها تلك الدراسة.
Cryptocurrencies, especially bitcoin as a leading model in this field, have gained the attention of many international bodies, legislative systems and comparative jurisprudence, as they have been shown to express a technical revolution that demolishes many entrenched constants, especially in the area of state control over the financial system, and to have a number of features that make them attractive to criminals. Specifically, it was noted that money launderers were attracted to anonymity, easy cross-border transfers, lack of clear regulations, and the finality of settlement that accompany cryptocurrency transactions.
We have sought to highlight the risks of cryptocurrency by using it for money-laundering offences, by relying on the analytical rooted method. We also relied on the comparative approach to study the international approach as represented in the position of the United Nations and the Financial Action Group, And the legislative approach represented by the United States federal and Egyptian legislation to identify all potential risks of cryptocurrencies and to realize the best legislative practices in combating and identifying strengths, weaknesses, effectiveness and opportunities for improvement. To successfully assess Egypt's handling of cryptocurrency risks and assess its responses to the evolving risk.
We tried to reach this goal by dividing the research itself into three chapters. In chapter I, we were exposed to the concept and legal nature of cryptocurrencies. We devoted chapter II to assessing the risk of cryptocurrencies in money-laundering offences. In chapter III and chapter III, we addressed the comparative international and legislative approach to addressing cryptocurrency risks in money-laundering. We then concluded this research by outlining the main findings and recommendations of that study.
