السياسة التشريعية الإجرائية في جرائم الاستثمار "دراسة مقارنة"

قد أدى التطور فى ظروف الحياة السياسية، والاقتصادية، والاجتماعية وما شهده العصر الحديث من سهولة الاتصال بين المجتمعات المختلفة، إلى ظهور علاقات اقتصادية وقانونية لم تكن معروفة من قبل، مثل الاستثمارات الأجنبية، والتى أولتها التشريعات الوطنية والدولية معاملة خاصة، تفوق تلك التى يتمتع بها المستثمر الوطنى، لما تعول إليه الدولة المضيفة من دفع عجلة التنمية والتقدم الاقتصادى، والاجتماعى، فأولت تلك الاستثمارات بالكثير من المزايا والتسهيلات بهدف جذب رؤوس الأموال. لأن الاستثمار من العوامل الأساسية الهامة فى تحقيق النمو الإقتصادى، حيث يعتبر المحرك الرئيسى للنشاط الاقتصادى لارتباطه المباشر بالتكوين الرأسمالى، وإمكانياته فى زيادة قدرة الاقتصاد الوطنى للإنتاج والتطوير والتجديد.
وتلاحظ لنا أن هناك زيادة واضحة في عدد جرائم الاستثمار. وهذه الجرائم قد أثرت على الرأي العام بالنظر إلى ضخامة الأموال محل هذه الجرائم، وإلى ما تحدثه إجراءات الضبط والتحقيق والمحاكمة في هذه الجرائم من آثار جسيمة على سوق المال، وبالتالي انتشار الاضطراب وعدم الثقة، وتفقد البيئة استقرارها الذي هو أساس لجذب الاستثمار. أضف إلى ذلك أن نظر بعض الدعاوى الجنائية أمام المحاكم قد أثار إشكاليات قانونية مهمة في نطاق التجريم.
The development in the conditions of political, economic, and social life, and the ease of communication between different societies witnessed in the in the modern era, led to the emergence of economic and legal relations that were not know before, such as foreign investments, which national and international legislation accorded special treatment,exceeding those enjoyed by the national investor; due to the host country΄s dependence on advancing development and economic and social progress, these investements were given many advantages and facilities with the aim of attracting capital.Because the investment is one of the main and important factors in achieving economic growth, as it is the main driver of economic activity due to its direct connection to capital formation, and its potential to increase the capacity of the national economy for production, innovation and development.
 It was noticed to us that there is a clear increase in the number of investment crimes, and these crimes have affected the public opinion in view of the large sums of money in these crimes, and the control, investigation and trial procedures in these crimes have serious effects on the capital market, Trust, lose the environment and its stability which is the basis for attracting investment. In addition, the consideration of certain criminal cases before the courts has raised significant legal problems within the scope of criminalization.
