تعليق حول الأمر الصادر عن محكمة الإسماعيلية الاقتصادية بالحجز التحفظي على السفينة ايفرجيفن فى قناة السويس لسنة 2021

تصدرت وسائل الإعلام في جميع أنحاء العالم أزمة جنوح السفينة البنمية ايفرجفين وهي تسد مجرى قناة السويس على مدى ستة أيام اعتباراً من 23/3/2021 حتى 29/3/2021. وصدر الأمر من محكمة الاسماعيلية الاقتصادية بالحجز التحفظى على السفينة ايفرجيفين.
يطرح البحث مشكلة رئيسية تتمثل فى: ما مدى فاعلية نظام الحجز التحفظى على السفينة ايفرجيفين في ضمان حقوق كل من الدائن الحاجز، والمدين المحجوز عليه، والغير؟
يسعى الباحث تحقيق الأهداف التالية:
-       بیان خصوصية الحجز التحفظى على السفينة فى مصر وفرنسا.      
-       ابراز أحكام وقواعد الحجز التحفظي الواردة في قانون التجارة البحرية المصرى، وقانون المرافعات ومقارنتها بأحكام القانون الفرنسى سواء الواردة فى قانون النقل او فى قانون الاجراءات المدنية للتنفيذ الجبرى.
-       التعليق على الأمر بالحجز التحفظي رقم 26 لسنة 2021 بحرى اقتصادى الاسماعيلية الصادر بتاريخ 12/4/2021 الموقع على السفينة ايفرجيفين المتراكية فى البحيرات المرة بالاسماعيلية، ورفض التظلم منه وتأييد الأمر بالحجز التحفظى رقم 26 لسنة 2021.
-       التعليق على الأحكام الصادرة عن محكمة الاسماعيلية الاقتصادية فى الإستئناف رقم 35 لسنه 14 ق اقتصادى الدائرة الاستئنافية بتاريخ 23/5/2021، والدعوى رقم 23 لسنه 14 ق اقتصادي الدائرة الاستئنافية.

The research poses a main problem represented in: How effective is the precautionary seizure system on the ship Evergevin in ensuring the rights of each of the seizing creditor, the seized debtor, and others?
 The researcher seeks to achieve the following objectives:
Statement of the privacy of the precautionary seizure of the ship in Egypt and France
To highlight the provisions and rules of precautionary seizure contained in the Egyptian Maritime Trade Law, and the Procedures Law, and compare them with the provisions of the French law, whether contained in the Transport Law or in the Civil Procedures Law for Forced Execution
Commenting on the precautionary seizure order No. 26 of 2021, an economic, marine, Ismailia issued on 12/4/2021, signed on the ship Evergevin, which is anchored in the Bitter Lakes in Ismailia, and refused to appeal against it and affirmed the precautionary seizure order No. 26 of 2021
