الضمانات الدستورية لحرية الصحافة والرأى والتعبير بين النص والتطبيق "دراسـة فقهية قضائية مقارنـة"

تهدف هذه الدراسة إلى تناول الضمانات الدستورية لحرية الصحافة والرأى والتعبير بين النص والتطبيق، وذلك نظراً للمكانة الرفيعة التى تتبؤها حرية الصحافة بإعتبارها احدى روافد حرية الرأى والتعبير وأيضاً تحتل حريتى الصحافة والرأى والتعبير منزلة عالية فى النظام الديمقراطى، فلا قيام للديمقراطية بدون حرية الصحافة والنشر وحرية الرأى والتعبير، فلا تستطيع الصحافة أن تعيش بدون حرية الرأى والتعبير وتحرير إرادة الكلمة من القهر، فحرية الصحافة ضرورة لا غنى عنها لأى مجتمع ديمقراطى يسعى للتقدم والإستقرار ويهدف إلى مكانة سامية بين دول العالم المتحضر، وبالرغم من أن هذا الدور المهم لحرية الصحافة والنشر فى أى نظام ديمقراطى فى العالم إلا أن هذا لايعنى أنها حرية مطلقة بلا حدود وإلا إنقلبت فوضى وحملت فى طياتها البغى والعدوان على حريات وحقوق الأفراد فلابد من وضع ضوابط تكفل فى ممارستها حفاظاً عليها وعلى أفراد المجتمع. وسنتناول الدراسة التحليلية المقارنة للنصوص القانونية المنظمة لحرية الصحافة والرأى والتعبير فى القانون المصرى والفرنسى، ومن ثم تعتمد هذه الدراسة على عدة محاور أساسية: يكمن المحور الأول في إبراز آليات الحماية القانونية لحرية الصحافة، بينما يتمثل المحور الثاني في مبادئ قضائية قررتها المحكمة الدستورية العليا بشأن حرية الصحافة والنشر، في حين أن المحور الثالث يتجسد في إيضاح مفهوم حرية الرأى والتعبير واهتمام الدساتير المصرية المتعاقبة بحرية الرأى والتعبير، ويتناول المحور الرابع فى إيضاح مبادئ قضائية قررتها المحمكمة الدستورية العليا بشأن حرية الرأى والتعبير، ثم تُزيل الدراسة بخاتمة تشتمل على قائمة المصادر والمراجع.
This study aims to address the constitutional guarantees for freedom of the press, opinion and expression between the text and the application, due to the high status that freedom of the press occupies as one of the tributaries of freedom of opinion and expression, and also the freedom of the press, opinion and expression occupies a high position in the democratic system, so there is no democracy without freedom of the press, publication and freedom of opinion And expression, the press cannot live without freedom of opinion and expression and liberating the will of the word from oppression. Freedom of the press is an indispensable necessity for any democratic society that seeks progress and stability and aims for a lofty position among the countries of the civilized world. Although this is an important role for freedom of the press and publishing in any system democracy in the world, but this does not mean that it is absolute freedom without borders, otherwise it will turn into chaos and carry with it oppression and aggression against the freedoms and rights of individuals. We will deal with the comparative analytical study of the legal texts regulating freedom of the press, opinion and expression in Egyptian and French law, and then this study depends on several main axes: Press and publishing, while the third axis is embodied in clarifying the concept of freedom of opinion and expression and the interest of successive Egyptian constitutions in freedom of opinion and expression. The fourth axis deals with clarifying judicial principles decided by the Supreme Constitutional Court regarding freedom of opinion and expression. From sources and references.
