يهدف هذا البحث إلى إلقاء الضوء علي دور الإرادة في مجال إجراءات تنفيذ الأحكام الأجنبية، وكذا ما يترتب علي دور الإرادة في مباشرة تلك الإجراءات أمام المحكمة المختصة. فيلزم وفقا˝ للقانون المصرى أن يكون الحكم المراد الإعتراف به وتنفيذه في مصر صادراً عن هيئة قضائية مختصة من الوجهة الدولية (م298/1مرافعات).
This paper aims to shed light on the role of the will in the field of the proceedings of the execution of foreign judgments، as well as the consequences of the role of the will in undertaking these proceedings before the competent court. It is necessary according to the Egyptian Law that the judgment in order to be recognized and executed should be issued by an internationally competent jurisdiction (pleadings vol. 1/289‪).
