الجريمة المعلوماتية في شأن حق المؤلف على الإنترنت طبقا للتشريع المصري (نظرة تحليلية خاصة لقانون مكافحة الجرائم المعلوماتية الجديد)

إن الجريمة المعلوماتية تعتبر وباء حقيقي يحتاج الي تضافر كافة الجهود الدولية والعربية علي حد سواء. وجاء ذلك بناءا علي تقرير أعده إتحاد منتجي برامج الكمبيوتر التجارية المنشئ عام (1988) الذي يلعب دورا محوريا في شأن حماية حقوق التأليف والنشر الإلكتروني وحماية أمن المعلومات وتجارة البرمجيات والتجارة الإلكترونية عبر شبكة الإنترنت باعتبار ما سبق ذكره حق أصيل للمؤلفين علي شبكة المعلومات الدولية. الأمر الذي ساهم في قيام المشرع المصري بمحاولات تطبيق النصوص التقليدية علي الجرائم المعلوماتية والمتمثلة في الاعتداء علي حقوق المؤلفين عبر شبكة المعلومات الدولية. وتأسيسا علي ما سبق فقد أصدر المشرع المصري القانون رقم (175) لسنة 2018م لمكافحة جرائم تقنية المعلومات لمواكبة التطور المذهل في عالم السرقات الأدبية في البيئة الرقمية مع نظرة تحليلية قانونية خاصة لهذا القانون في شأن حماية حقوق المؤلفين علي شبكة الانترنت.
Information crime is a real epidemic that requires the concerted efforts of all international and Arab efforts alike. This was based on a report prepared by the Commercial Computer Software Producers Association established in 1988, which plays a pivotal role in the protection of electronic copyright and information security, software trade and electronic commerce via the Internet, given that the aforementioned is an inherent right of authors on the international information network.
This contributed to the Egyptian legislator's attempts to apply the traditional texts to information crimes represented in the infringement of authors' rights through the international information network. Based on the above, the Egyptian legislator issued Law No. (175) for the year 2018 AD to combat information technology crimes in order to keep pace with the amazing development in the world of plagiarism in the digital environment, with a special legal analytical view of this law in the matter of protecting the rights of authors on the Internet.
