دور نظام التسليم المراقب الدولي في مكافحة الانتشار غير المشروع للمخدرات

تتميز مختلف صور الانتشار غير المشروع لجرائم المخدرات والمؤثرات العقلية بطابعها المعقد، وامتدادها عبر الوطنية، وارتباطاتها بمجموعة من الشبكات الإجرامية، وهو ما يجعل مهمة رصدها ومكافحتها ليست بالسهولة المألوفة في بعض الجرائم العادية، لذلك استحدثت السياسة الجنائية وسائل وأساليب للتصدي لها ومكافحتها والتقليل من تداعيتـها الخطيرة، ومن بين الوسائل التي اعتمدتها التشريعات الجنائية لمكافحتها، أسلوب التسليم المراقب. كألية من آليات البحث والتحري، لإقامة الدليل على ارتكاب الجريمة، وذلك عن طريق تتبع المجرمين والعائدات المتحصلة من إجرامهم، سيرا على نـهج الاتفاقيات الدولية التي عنيت بمكافحة الانتشار غير المشروع للمخدرات، وحثت على التعاون الدولي وطرح العديد من الأليات والوسائل لمكافحة هذه الجرائم ومحاولة إثباتها وإقامة الدليل على ارتكابها، وأبرزها الأخذ بنظام التسليم المراقب، والذي يعد أبرز آليات التعاون الدولي في مكافحة جرائم الاتجار غير المشروع بالمخدرات من خلال قطع الطريق أمام التنظيمات الإجرامية من عبور الحدود بين الدول، خاصة وأنه يلعب دورا رئيسيا في تحقيق الأمن الدولي الناتج عن تظافر الجهود الدولية وتضامنها بين الأطراف المعنية، علاوة عن إثباته لجدواه كآلية فعالة في مكافحة الإتجار غير المشروع في المخدرات يتم من خلاله استخلاص الدليل على ارتكاب الجريمة حتى لا يتفلت المجرم من العقاب. وبموجبه يمكن للسلطات المختصة بمكافحة التهريب، أن تسمح تحت رقابتها بمرور الشحنة غير المشروعة أو المشبوهة أو دخولها إلى الإقليم الوطني أو الخروج منه بغرض البحث عن أفعال التهريب ومحاربتها.
The various forms of illicit spread of drug and psychotropic substances crimes are characterized by their complex nature, their transnational extension, and their links to a group of criminal networks, which makes the task of monitoring and combating them not as easy as usual in some ordinary crimes. Therefore, criminal policy has developed means and methods to address and combat them and reduce their serious repercussions. Among the methods adopted by criminal legislation to combat it is the method of controlled delivery. As a mechanism of research and investigation regarding transient crimes in order to track criminals and the proceeds obtained from their crime, in accordance with the approach of international agreements concerned with combating the illegal spread of drugs, and urged international cooperation and put forward many mechanisms and means to combat these crimes, most notably the introduction of the controlled delivery system, and providing evidence of their commission which is the most prominent mechanism of international cooperation in combating illegal drug trafficking crimes by blocking the way for criminal organizations to cross borders between countries, especially as it plays a major role in achieving international security resulting from concerted international efforts and their solidarity between the concerned parties, in addition to proving its feasibility as an effective mechanism in combating illegal drug trafficking.
According to it, the authorities competent to combat smuggling can, under their control, allow the illegal or suspicious shipment to pass through or enter or leave the national territory for the purpose of searching for and combating smuggling acts.
