دور البصمة الوراثية كقرينة فى إثبات أو نفى النسب من منظور الفقه الإسلامى

إن الله سبحانه وتعالى قد جعل الشريعة الإسلامية خاتمة الشرائع السماوية شرع فيها من الأحكام ما جعلها صالحة لكل زمان ومكان وقد اشتملت هذه الشريعة على أحكام شاملة وقواعد كلية مما يجعل أهل العلم يتعرفون من خلالها على أحكام كل ما يجد من حوادث ونوازل وان من نوازل هذا العصر البصمة الوراثية. والبصمة الوراثية لها دور فى إثبات النسب أو نفى وهذا البحث تناولناه فى ثلاثة مباحث وقسمنا المباحث إلى مطالب والمطالب إلى فروع على حسب المادة العلمية. وقد عرفنا البصمة الوراثية وبعض المصطلحات المترتبة عليها وعرفنا النسب وبينا وسائل إثباته وذكرنا آراء الفقهاء فى حجية البصمة الوراثية فى إثبات النسب أو نفيه وذكرنا خصائص البصمة الوراثية وضوابطها التى يجب مراعاتها عند العمل بها والتى منها الخبرة والدراية والدقة والثقة والعدل والأمانة فيمن يقومون بها.

We have known the DNA fingerprint and some of the terms related to it, and we have known the lineage and explained the means of proving it and mentioned the opinions of the jurists on the authenticity of the DNA print in establishing or denying lineage and we mentioned the characteristics of the DNA print and its controls that must be taken into account when working with it, which includes experience, know-how، accuracy, trust, justice and honesty in those who carry it out.
