الحماية الجنائية والشرعية للجنين (دراسة مقارنة)

وهب الله تعالى الإنسان الحياة وخلقه في أحسن تقويم وشمله بكافة أنواع الحماية بدءً من بداية تكوينه ومروراً بجميع مراحل تطوره والتي منها مرحلة الجنين وانتهاءً بوفاته، بل هو محمي حتى بعد وفاته كما دلت بعض نصوص الشريعة الإسلامية الغراء، قال ﷺ {كسر عظم الميت ككسر عظم الحي}^([1]). وهو ما يدل على أن كرامة الإنسان مصانة في شريعة الله تعالى في حياته وبعد مماته. وكذلك أكدت القوانين والتشريعات الوضعية تلك الحماية من خلال قواعد وضوابط تحفظ حقوق الإنسان وتجرم الإعتداء على أي حق من حقوقه.
ولقد جاء هذا البحث لإظهار اهتمام الشرائع والسياسات المختلقة بشؤون الجنين ورعايته، خاصة بعد التطور العلمي ومنها التطور العلمي في مجال الطب والهندسة الوراثية الذي أدى إلى الإعتداء على حق الجنين كاستعمال الاجنة في الأبحاث لأغراض علاجية أو تجارب طبية وغير ذلك من الاستعمالات التي تؤدي بعضها إلى انتهاك حرمة هذا الكائن البشري المكرم، وتزداد هذه الإنتهاكات بشاعة كون هذا الكائن ضعيف بسبب عدم اكتمال نموه ومن ثم يسهل استغلاله بارتكاب جرائم مختلفه عليه.

This research came to show the interest of different laws and policies in the affairs of the fetus and its care, especially after the scientific development, including the scientific development in the field of medicine and genetic engineering, which led to the assault on the right of the fetus, such as the use of embryos in research for therapeutic purposes or medical experiments and other uses that some of them lead to violation The sanctity of this honorable human being, and these violations are made worse by the fact that this being is weak due to its incomplete growth, and then it is easy to exploit it by committing various crimes against it.
