تطور أحكام الإثبات الإلكتروني تحت تأثير التقدم العلمي والتكنولوجي وفقأ للمرسوم بقانون اتحادي رقم 35 لسنة 2022م "دراسة مقارنة"

لاشك في أن التطور العلمي والتقني الذي يشهده العالم في الوقت الحاضر يؤثر على جميع القواعد القانونية في شتى الميادين والقانون كغيره من المجالات التي تتسارع وسائل تطويره بتطور المجتمعات والتفاعل معها بإيجابية، وذلك لكونه هو حجر الأساس في تحقيق العدالة بين أفراد المجتمع، بما ينعكس في النهاية عليه أمناً وأماناً واستقراراً وتقدماً. وفي مجال الإثبات، يمكن القول بصفة عامة أن نظام الإثبات قد تأثر بهذا التطور الهائل في العلوم والتكنولوجيا. وبدا واضحا هذا التأثر على طرق الإثبات من أكثر من ناحية.
فمن ناحية، أدى تطور العلوم الطبية والنفسية إلى وجود أدلة إثبات جديدة، مثل تحليل الدم والبصمة الوراثية،
ومن ناحية أخرى، وجدت أدلة إثبات مستمدة من تقدم علوم الحاسب الآلي وتكنولوجيا الاتصال، مثل الهاتف. وقد استجاب المشرع في كثير من البلدان للتطورات الحاصلة في النظم القانونية المقارنة فعمل على تطوير نظام الإثبات في المواد المدنية والتجارية، حيث أدخل فيه وسائل الإثبات الإلكترونية هو ما يتضمنه البحث.
There is no doubt that the scientific and technological developments witnessed by the world today have an impact on all legal rules in various fields, including law, which like other areas, is accelerating its development methods with the development of societies and positive interaction with them. This is because it is the cornerstone in achieving justice among members of society, which ultimately reflects on their security, safety, stability, and progress.
In the field of evidence, it can be generally said that the system of evidence has been affected by this enormous development in science and technology. This impact on the methods of proof is clear from several perspectives. On the one hand, the development of medical and psychological sciences has led to the existence of new evidence, such as blood analysis and genetic fingerprinting. On the other hand, evidence derived from the advancement of computer science and communication technology, such as phones, has been found.
Legislators in many countries have responded to the developments in comparative legal systems and worked to develop the system of evidence in civil and commercial matters, introducing electronic evidence methods, which are included in this research.
