أدي التقدم التكنولوجي الهائل وإستخدام الوسائل التقنيه الحديثه والانترنت في إتمام المعاملات التجاريه وإبرام العقود الالكترونيه وتنفيذها عبر شبكة الانترنت، الي إستخدام نفس التقنيات الإلكترونيه لتسوية ما قد ينشأ عن هذه الاعمال من منازعات، وأمام عجز القضاء عن اللحاق بالطفره الالكترونيه وتوفير وسائل سريعه لفض منازعات التجاره الالكترونيه، أصبحت الحاجه ملحه للبحث عن سبل أكثر نجاحاً لفض المنازعات تتلائم والآليه التي نجمت عنها الخلافات بين المتعاقدين علي الحفاظ في ذات الوقت علي متطلبات التجاره الالكترونيه القائمه علي السرعه والثقه بين الاطراف، فكانت نتيجه جهودها التحكيم الالكتروني، ولما كان إتفاق التحكيم هو جوهر عملية التحكيم الالكتروني فقد إرتأينا إعداد هذه الورقه العمليه التي تبحث ماهيه إتفاق التحكيم الالكتروني وصوره وشروطه وماتنتهي إليه هذه الورقه البحثيه من نتائج وتوصيات.
