جريمة تهريب الآثار " دراسة مقارنة وتحليلية"

الآثار هي كل شيء ينتمي إلي الماضي له قيمة تاريخية وعلمية، يكون قد مر عليه مائة عام علي الأقل. وهذه الآثار مكون لشخصية الأمة وانتماء الشعب وهويته كما أنها تنير المستقبل وتفيد في بيان سلوك الأفراد وعاداتهم وتقاليدهم. وقد حمي المشرع هذه الآثار منذ النصف الثاني من القرن العشرين، وجرم الاعتداء عليها، خاصة التهريب والسرقة ونقل الآثار إلي خارج الدولة. ويدعم القانون الدولي هذه الحماية، بشكل أقل وفي مفهوم أضيق، مما يدعو لتطوير هذه الحماية والعمل علي استرداد الآثار المهربة.
