المسئولية الجنائية للتوائم الملتصقة "دراسة مقارنة" (بين الفقه الإسلامي والقانون)

يعمدُ هذا البحث إلى مسايرة ما كان هامشيًّا وأضحى مركزيًّا بعد التطورات التي أصابت العالم وجعلت للجريمة سُبُلًا أيسر لا تعتمد فقط البذل الجسدي والجهد العضلي، بحيث لم يعد الجسد معوِّقًا في ارتكاب الجريمة، ولم تعد الحالات الخاصة بمنأى عن التداول اليومي، فلم يعد شيء يعيش على الهامش، من هنا كانت محاولة مناقشة الجريمة المتعلقة بالتوأم الملتصق ملحةً لسد ثغور قانونية قد تتفاجأ بها المحكمة، لذا اجتهد الباحث في توضيح ماهية التوائم الملتصقة، عبر سَبْرِ مفاهيمها السالفة والإضافة إليها، وبيان أنواعها، وطبيعتها الشرعية والقانونية، مبينًا مسئوليتهما من الناحيتين الشرعية والوضعية، ومفصلًا حالات وقوع الاعتداء عليهما أو وقوعه منهما على غيرهما، واستنادًا لمسئوليتهما تتضح عقوبتهما حال ارتكابهما للجريمة أو ارتكاب أحدهما لها وكيفية ضمان عدم امتداد أثرها البدني أو النفسي للآخر، استنادًا لكونهما شخصين مسئولين تتباين مسئوليتهما وبالتالي عقوبتهما، مساهمة في وضع تصور لقانون جنائي يتناول تلك الحالة الخاصة دون ترك فراغ ينفذ منه الجاني دون عقاب.
This research tends to keep pace with what was marginal and has become central after the developments that hit the world, and made crime easier ways that do not depend only on physical exertion and muscular effort, so that the body is no longer disabled in committing the crime, and the Special cases are no longer immune to day trading, Nothing lives on the sidelines anymore. Hence, the attempt to discuss the crime related to the conjoined twins was urgent to fill legal gaps that might surprise the court. Therefore, the researcher worked hard to clarify the nature of conjoined twins, by probing it’s above concepts and adding to them, and indicating their types, and their legal and legal nature, Indicating their responsibility in terms of legitimacy and status, and detailing the cases of assault on them or their occurrence on others, Based on their responsibility, their punishment is clear if they commit the crime or one of them commits it and how to ensure that its physical or psychological impact does not extend to the other twin. Based on the fact that they are responsible persons whose responsibilities vary and then their punishment. Contribution to the conceptualization of a criminal law that deals with that particular case without leaving a vacuum from which the offender can go unpunished.
