الأحكام النظامية المتعلقة بتعويض المضرور من ناقل فايروس كورونا إلى الغير إهمالاً "دراسة تحليلية ومقارنة وفقاً لنصوص نظام المعاملات المدنية السعودي وبعض الأنظمة الأخرى"

ما من شك أن فايروس كورونا له آثاره البالغة والمختلفة، والتي تتطلب تدخلاً من المنظم في وضع الإجراءات النظامية اللازمة للحد من انتشاره وبيان المخالفات المتعلقة به ووضع العقوبات اللازمة لذلك وبيان الأحكام النظامية المتعلقة بالتعويض عن الأضرار الناجمة عنه، وقد تناول هذا البحث قواعد النظام المدني السعودي بمفاهيمها العامة وبما نص عليه نظام المعاملات المدنية السعودي على وجه الخصوص وبيان الأساس النظامي بثبوت المسؤولية على أساس الخطأ والإهمال في حال نقل العدوى بفايروس كورونا للغير وثبوت الضرر في النظام السعودي والأنظمة الأخرى المقارنة، وبيان الأحكام النظامية في حال إذا ما قامت أركان المسؤولية التقصيرية الثلاثة: الخطأ، والضرر، والعلاقة السببية بينهما بثبوت الحق بطلب التعويض عن الضرر من عدمه، والإشارة إلى بعض الأحكام القضائية ذات العلاقة في المملكة، ومن ثم تم ختم البحث بأبرز النتائج والتوصيات ومن ذلك بيان أهمية استحداث منصة وطنية متخصصة في الأمراض والفايروسات المعدية، يكون في هذه المنصة لجان من كافة التخصصات تتابع المستجدات، وتصدر كل ما يلزم بخصوص ذلك، بما في ذلك لجنة نظامية تتابع الأحداث المستجدة، وتصدر اللوائح المؤقتة والأنظمة الدائمة لذلك، حيث ظهرت الحاجة لذلك من خلال الجائحة، وإصدار نظام يخص منع وتجريم نقل الأمراض المعدية إلى الغير ووضع الأحكام الكافية للتعويض عن الأضرار الناجمة عن نقل العدوى والتضرر منها.
