طبيعة المجلس الدستوري بين الاعتقاد القضائي والحقيقة السياسية

إنَّ موضوع هذا البحث هو العمل على تحديد طبيعة الماهية والطبيعة المهنية لهيأة الرقابة السياسية على دستورية القوانين، للتأكيد من صحة وصفها وصفاً حقيقياً ودقيقاً، ما إذا كانت هيأة قانونية أو قضائية من حيث الماهية والمهنة بموجب اختصاصها النوعي؛ أم هي هيأة ذات طبيعة سياسية؛ وبالبحث تأكدت لنا الحقيقية التي تنطبق على صحة طبيعتها السياسية، وهذا ما ينفي صحة وصفها بالطبيعة القانونية أو القضائية. وذلك من خلال عدة معطيات ودلالتها بتأكيد هذه الحقيقة التي لا تقبل شيئاً من الشك في صدقها، وذلك كالآتي:
أولاً- بالعودة إلى تاريخ وبيئية نشأة هيأة الرقابة السياسية لأول مرة في التاريخ الإنساني، فالغاية منها أصلاً ما كانت البحث عن إيجاد هيأة قانونية أو قضائية لحماية الدستور، وإنَّما كانت النية منصرفة للبحث عن كيان سياسي لحماية الدستور.
ثانياً- منطقياً أنَّ اشتقاق المسمى يأتي من طبيعة الهوية الذاتية أو المهنية، وإنَّ مسمى هذه الهيأة هو كونها (هيأة سياسية) وليس هيأة قانونية أو قضائية مما يُؤكِّد صحة وحقيقة طبيعتها السياسية.
ثالثاً- من حيث طبيعة الاختصاص المهني بموجب دستور أصل بيئة المنشأ فإنَّ المواد من أصل ست مواد دستورية خمسة منها تتكلم عن اختصاص سياسي لهيأة الرقابة السياسية، بينما مادة واحدة فقط هي التي تًعطي الهيأة حق الاختصاص القانوني بمراقبة دستورية القوانين.

Through research, we have confirmed the truth that applies to the validity of its political nature, and this is what negates the validity of describing it as having a legal or judicial nature. This is through several data and their significance confirms this fact that does not accept any doubt about It is true, as follows:
First: by returning to the history and environment of the emergence of the Political Oversight Authority For the first time in human history, its original purpose was not to search for a legal or judicial body, but rather the intention was to search for a political entity to protect the constitution.
Secondly: Logically, the derivation of the name comes from the nature of self-identity, and the name of this body is its being a body. It is a political and not a legal or judicial body, which confirms its validity And its true political nature.
Third: in terms of the nature of professional jurisdiction under the Constitution of the Origin Environment, out of six constitutional articles, five of them speak about political jurisdiction afor the oversight body. political, while only one article gives the Commission the right of legal jurisdiction to monitor the constitutionality of laws.
