دراسة مدى التزام المؤجر (شرکة التأجيرالتمويلي) بضمان الأصل المؤجر (دراسة تحليلية مقارنة )

من الالتزامات التي تقع على عاتق المؤجر في عقد التأجير التمويلي تمکين المستأجر من الانتفاع بالمأجور بشکل سليم وهادى، الا أن ذلک لايکفي بل لابد ان ينص المشرع صراحة على التزام المؤجر بضمان الأصل المؤجر، وفيما يتعلق  بالتزامات المؤجر، فانه نظرا لان عقد التأجير التمويلي  يقوم على تأجير تجهيزات ومعدات والآلات والعقارات يکون المؤجر اشتراها  بهدف تأجيرها مع الاحتفاظ بملکيتها. فان هذا العقد يرتب على المؤجر (الممول) التزامات  تبدأ من الاتفاق  على شراء المواد  ثم اداء ثمنها  ومن ثم تسليم الماجور الى المستأجر لينتفع به وکذلک التزام المؤجر بالضمان، وهنا لايتحمل المؤجر أي ضمان لاي عيب يظهر في المبيع (موضوع عقد التأجير التمويلي) لان المستاجر في هذا العقد هو الذي تفحص الماجور واتفق مع بائعه على شرائه. أما المؤجر فانه يضمن  عدم تعرضه هو وکذلک عدم تمکين  المورد او المقاول من التعرض في الماجور فقط، اضافة لأي التزامات أخرى ممکن ان تحدد بشکل عام  في عقد التأجير التمويلي نفسه.
Abstract
One of the obligations of the lessor in the lease is to enable the tenant to make proper and calm use of the wage, but this is not enough, but the legislator must expressly state the obligation of the lessor to guarantee the leased asset, and with regard to the obligations of the lessor, since the lease contract is based on the rental of equipment, equipment, machinery and real estate that the leased was purchased with the aim of renting it while retaining ownership. This contract arranges for the lessor (financier) obligations starting from the agreement to purchase the materials and then to pay for them and then handing over the property to the tenant to benefit from it as well as the obligation of the lessor to guarantee, and here the lessor does not bear any guarantee for any defect that appears in the sale (subject of the lease finance) because it is the tenant in this contract who examined the agent and agreed with his seller to buy it. The lessor ensures that he or she is not exposed to himself, nor does the supplier or contractor be able to be exposed to the major, in addition to any other obligations that may be generally specified in the lease.
