حدود سلطات الضبط الإداري وأثرها على الحريات العامة

 يدور هذا البحث حول الضبط الإداري وأثره في الحريات العامة بأن وظيفة الضبط الإداري قديمة قدم الدولة ذاتها وتـعـتـبـر وظيفة ضرورية ولازمة لحماية المجتمع، ووقاية النظام العام، إذ بدونها تعم الفوضى، ويسود الاضطراب ويختل التوازن في المجتمع، وتشكل خطرا يبدد المجتمع وغالبا ما تنتهي إلى نوع من العبودية.
إن الضبط الإداري نابع من رغبـة الأفراد أنفسهم في تنظيم شئونهم وأنشطتهم والحفاظ على حقوقهم، وحرياتهم، فـالـضـبط الإداري لا يسلب الـفـرد حـريـتـه، أو يصـادرها ولكن ينظم ممارستها إلى حد معين ينتهي عند الحدود المملوكة للغير، ولا يتعداها فإذا تعداها إلى الإضرار بحقوق وحريات الآخرين وجب على الإدارة إيقافه عنده باتخاذ إجراءات ضبطية في مواجهته بما تملكه من سلطة بمقتضى نص قانوني أو لائحي.
وللضبط الإداري آثار على حريات الأفراد قد تكون في ظل الظروف العادية أو الاستثنائية، بمعنى أن هيئات الضبط الإداري عند ممارستها لسلطاتها تتقيد بالقانون، وذلك إعمالا لمبدأ المشروعية، ولكن ذلك لا يعني التقييد على إطلاقه إنما هناك استثناء في حالة الظروف الاستثنائية كالحرب والكوارث مثل الفيضانات. هنا يمكن اتخاذ إجراءات ضرورية لمواجهة هذه الحالة حتى لو كان خروجا عن القواعد العامة، وذلك إعمالا لنظرية الضرورة، وبذلك نكون قد وصلنا لأهمية الضبط الإداري التي يتمثل في أنه يؤدي إلى ضبط سلوك العامة والوصول إلى غاياته المحددة، كما أنه ذو ارتباط بـالصـحـة والاقتـصـاد والسياسية داخل أي دولة، وعن طريق الضبط الإداري يحافظ على كيان الدولة وأمنها واستقرارها.

Here, necessary measures can be taken to confront this situation, even if it is a departure from the general rules, in accordance with the theory of necessity, and thus we have reached the importance of administrative control, which is that it leads to controlling the behavior of the public to reach its specific goals, and it is also related to health, economy and politics within Any state, through administrative control, maintains the entity, security and stability of the state.
