العقود الذكية المبرمة عبر تقنية البلوك تشين

لقد تأثر القانون بصفة عامة، وقانون العقود بصفة خاصة، بالتطور العلمي والتقني في العصر الحديث. وتتمثل أهم ابتكارات التطور التقني في ظهور ما يسمى بتقنية البلوك تشين التي أصبحت تمثل ركنا جوهريا في حياتنا المعاصرة، حيث يمكن عن طريقها استخدام الذكاء الاصطناعي في تسهيل إبرام العقود والتصرفات القانونية، وتنفيذها بطريقة آلية وتلقائية دون حاجة إلى تدخل العنصر البشري، فظهر ما يطلق عليه بالعقد الذكي. ولكن مازال يفتقر استخدام تقنية البلوك تشين والعقود الذكية التي تبرم خلالها إلى التنظيم التشريعي أو الإطار القانوني، وذلك نظرا لحداثة هذه التقنية، وللتخوف من بعض الإشكاليات المتعلقة بالعقود الذكية، مثل الإشكالية التي تتعلق بأهلية المتعاقدين، وطريقة التعبير عن إرادتهما، والإشكاليات المتعلقة بتنفيذها، وتفسيرها. لذا تركز هذه الدراسة على معرفة ماهية العقود الذكية، وعلاقتها بتقنية البلوك تشين، وكذلك بيان خصوصية تكوين هذه العقود، وآلية عملها، والإشكاليات المتعلقة بإبرامها، وتنفيذها، وتفسيرها.
Law in general، and contract law in particular, has been affected by scientific and technical development in the modern era. The most important innovation of the technical development is the appearance of the so-called blockchain technology, which has become an essential element in our current life، through which artificial intelligence can be used to facilitate the conclusion of contracts and legal transactions, and their automatic implementation without need for human intervention, which is called smart contracts.
However, there is no legal regulation or legal framework for the use of blockchain and smart contracts, due to the novelty of this technology, and the fear from some problems related to smart contracts, such as the problem related to the legal capacity of the contracting parties, the method of expressing their will, and the problems related to its implementation and interpretation.
Therefore, this study focuses on knowing what smart contracts are, and its relationship with blockchain technology, as well as explaining the specificity of the formation of these contracts، their working mechanism، and the problems related to their conclusion, performance، and interpretation.
